View Full Version : TX CHL, OK Address

I am hoping that someone can answer a question concerning CCW in Oklahoma. I recently returned of Oklahoma after being in Texas almost 10 years. I have an expired OK CHL and have sent in the paperwork to have it renewed. After moving to OK I sent an address change to the TX DPS and I have a TX CHL with my OK address. As I understand, TX issues out-of-state CHL's and OK honors a TX CHL. My question is, can I CCW in OK with my TX license while I am waiting for my OK CHL to be processed?

Title 21: 1290.26

"The State of Oklahoma Hereby recognizes any valid concealed weapons permit or license issued by another state.

Any person entering this state in possession of a firearm authorized for concealed carry upon the authority and license of another state is authorized to continue to carry a concealed firearm and license in this state; provided the license from the other state remains valid. The firearm must be carried fully concealed from detection and view, and upon coming into contact with any peace officer of this state, the person must disclose the fact that he or she is in possession of a concealed firearm pursuant to a valid concealed carry weapons permit or license issued in another state. Any person who is twenty-one (21) may apply for a concealed handgun license in this state immediately upon establishing a residence in this state."

Hmmm, I took that to mean "entering" as in visiting or passing through. Once you establish OK residency, wouldn't your "other state" permit become invalid here? Wouldn't you need to apply for OK CCW and not carry until you recieved it?

My "other state" permit does not expire....however, I went thru the process here, I'm waiting for my OK permit...that's the way I understood OSA.

Did I miss something?

Questions...

#1 Are you a resident of Oklahoma?
#2 Do you have a Oklahoma Drivers Liscense?
#3 Is your vehicle tagged with a Oklahoma Plate?

Yes to any of these, to me, would make your permit not valid. Scenario to think about. You have a Voters Card in Texas, can you vote in Oklahoma? Nope.

Remember this is an internet forum and I have yet to see a attourney answer these types of questions. Call the OSBI and ask them.

I think you're fine with the Texas non-resident for a reasonable time after the move. The SDA and voter registration laws have nothing to do with each other. We definitely have reciprocity with Texas, and if your TX CHL stayed in effect after you notified them of the address change, then it's valid here. Of course, I'd do like you're doing and get one here anyway.

Not tying the voter and SDA together,it was just an example. If he is a "Resident" of Oklahoma and no longer a resident of Texas and has a CCP from texas he is not legal in OK. it is the Oklahoma Self Defense Act, not the Texas self defense act for oklahoma residents.

Example: He can not obtain a OSDA permit if he is a Texas resident, only if he is an Oklahoma resident. Recipory agreements have nothing to do with this at all.

MMCBeat... You can do what you want, if I were you I would NOT carry until your permit is done in Oklahoma.

Okay, I gotta find out on this one. I just looked at the SDA, and it definitely says a person licensed in another state is good here AS LONG AS the other state's license is valid. SO, I am now goingto go see if Texas allows for a non-resident locense, many states do, and if by submitting the change of address, the license remains valid. I'll let you know, and of course, this research and opinion is worth exactly what you're paying for it. Sounds like it all hinges on the status of the TX license with the address change...

Well, that didn't take long. Submitting the address change before getting an OK DL and SDA permit may have been a mistake, here are the FAq's (http://www.txdps.state.tx.us/ftp/forms/ls-16.pdf#page=55) from TX DPS. One deals with moving. BUT, if it were me, I would read that to say that they may tell you to turn in your CCW. I woul THINK it's valid until they do, but I would get my OK one post haste. I really think you are acting in good faith and a REASONABLE officer / prosecutor should see that, but YMMV. Were it me, I wouldn't be caught without my peice, as aod said. I probably would've gotten my SDA permit FIRST, then let TX know I intended to stay in OK. Good luck. Welcome to OK.

Don't you also have to have an Oklahoma ID to get an Oklahoma resident SDA permit? Just get an Oklahoma driver's license and be done with it.........

"Good faith" might be demonstrated by following the law...even as it might apply to the time/residency requirements for registering your vehicle in Oklahoma and obtaining an OK DL.

I figure you could push the envelope only as far as you could convince anybody, police officer or judge, that you were not a real OK resident and were in transition between your new residence and the old one. At sometime, you'll get Catch-22'd by the processing time delay between application and reciept of your OK permit.
