I know you can recieve a DUI in a powerboat but what about a sail boat? We were having a discussion this evening and this came up. Can you get a DUI in a sail boat?

There are a couple local drunks in Norman that ride their bicycles everywhere.
I'm still curious on the sailboat.

I dont think so.
I do know that you can only be charged municipally for DUI/Boat, as the State Stautes do not provide for this. There must be a city Ordinance prohibiting this.

I thought that the OHP lake patrol was charging people with DUI/Boat, can they charge people with local Ordinance violations?

Unless something has changed, and it may well have, there is no State Staute for DUI Boating. However, I am not a marine expert, so I may very well be wrong. I do know that we had an issue a while back, and all we could charge was public intox.

OK guys, I was wrong. 100%, unabashedly wrong. I am not sure where I got my info, but it was screwed.

Looks like no Jail time, and a maximum fine of 1000 dollars.

Any idea if the .1 BAC is still .1 or is it now .08 like automobiles?

what i posted is current information. on the water is 0.10.
knowing a few lake patrolmen, there is a lot more to owning a boat then there used to be, or at least there is someone out enforceing the laws now. also depends on what lake.

There are open container laws in boats also for a while now I thought.
Funny side story a good friend is a HP Dispatcher in Ohio she got a call about a guy that had a motorised scooter went to check his mail at end of his driveway lived on a curve. He busted a U Turn in the streat to go back to his house car comes around corner SMACK rolled the dude on the motorized wheelchair.. The Wheelchair got the ticket for unauthorised motor vehicle on a state highway.. LMAO when I heard that.

Opps my bad I forgot to post that I was being facetious (http://dictionary.reference.com/search?q=facetious). Gosh all these forum intricacies are so hard to remember. I think it would be cool if the site took up donations and they could send me and Michael Brown to an Internet forum training class. That would be cool we could learn forum etiquette, proper smiley usage, how to show body language and tone on a forum. Yup that would be sweet.
