H.R. 17 - Citizens' Self-Defense Act of 2009
OK we have seen the bad (H.R. 45) now the good:

To protect the right to obtain firearms for security, and to use firearms in defense of self, family, or home, and to provide for the enforcement of such right

Probably not a chance that it will make it out of committee, but Dan Boren will get a note asking that he cosponsor.

Excellent post, we need some more of Borens constituents to email or write him for his support.
I have spoken to Rep. Boren about the Second Amendment in the past. I feel he is on our side but, I still get that tickle on the back of my neck feeling. I remember what David Boren did to us during the Clinton admin. Maybe it's just me but,,,,,,,. Anyway a note to Rep. Boren and the rest of the Oklahoma Delegation is a great idea. That's how we get things done. Thanks.

Is this an expansion of the Castle Doctrine? Here in MO we finally got Castle doctrine signed into law by our Governor last August. What's you home defense rules. Prior to Aug '08, homeowners had a "duty to retreat" not any more. Yeah!

(a) Reaffirmation of Right- A person not prohibited from receiving a firearm by Section 922(g) of title 18, United States Code, shall have the right to obtain firearms for security, and to use firearms--

I could support this bill if the words "shall have" are stricken and replaced with the word "has". That would truly be a reaffirmation. The right preexists the Constitution and any and all laws created under it. That would be in line with the prohibition upon government in the Second Amendment(Section 922(g) notwithstanding for the sake of discussion).

Re: H.R. 17 - Citizens' Self-Defense Act of 2009
Oops, I forgot to add the "why". Congress has no power to grant a right. This law could be shot down on those grounds. Congress can recognize a right(See the Ninth Amendment) and enact law to protect it (See the Fourteenth Amendment).

Re: H.R. 17 - Citizens' Self-Defense Act of 2009
Good point. Especially if this is not taken directly as reaffirmation but interpreted but some as a new and separate right "granted". If that was the case and the 2nd amendment didn't already provide the items listed in this bill, repealing this bill would allow them to prevent access to guns because the 2nd amendment would be worthless.

Boren is A NRA but he's an unknown as to how he'll respond when Pelosi comes a calling for support. She'll undoubtably threaten to "neuter" him(no commitee jobs) if he doesn't get in line with her.I suspect he'll cave. Steve

We've had a Castle Doctrine for over ten years. In Oklahoma it was referred to as the "Make my Day" law.
We've a Stand your Ground law for over a year.
