    Gillman I understand what you are saying but you don't know my grandmother, she used to be a badass MF'er in her day (and still is). As far as big dogs she (and my grandfather) have owned the gamut from pit bulls, rotts, etc. She goes on daily walks around the neighborhood for exercise and she has yet to be phased by all the big breeds that are out there.

    Anyway the owner pretty much told her that he didn't raise his dogs to be that way and this aggressive behavior had only started once he moved next door. He mentioned that if the behavior persisted that putting the dog down would become an option but my grandma said she would probably beat him to it.

    If OC spray is a more sound option (legally) I would even recommend that.

    Not saying anything about your grandma, other than an option to shooting the dog is trying to befriend it. You keep saying agressive behavior, but don't say what it is? From your posts the owner says it started when they moved, so what has the owner done about it? Going back to what I posted earlier, changes in enviroment and territory can create confusion in the dog, and their acting out due to fear or insecurity, is often perceived as agression. Take internet advice for what you paid for it. You asked for legality of killing a dog, I just suggested an option.

    +1 on the asshat owner. Majority of perceived "problem" dogs are the direct result of idiot owners. However, it's usually the poor dog who pays with an existence of misery or his life - too bad it's not the owner.

    I'd highly discourage discharge of a firearm as the method to deal with this problem. Sounds like she is living in a built up area with numerous homes in close vicinity. Last thing anyone in the area needs is someone chancing a pass-thru or errant shot killing/wounding some innocent neighbor.

    Had a guy I worked with shoot a big dog that had managed to get half her body under his fence and clamp down on his Pomeranian. The neighbor/owner of the dog was sitting there in a lawn chair watching the whole thing, he flipped his lid and called 911.

    The police didn't even ask questions once they saw the dog was across both yards.

    The Pom died.

    My grandma has told me she has to be ready to get back to her backdoor at any moment and she can only go so many feet away from the house for fear that she can't make it inside when the dog comes. Gillman the dog is running up and down the fence line barking and up until this evening was jumping over the fence at his discretion and pretty much chasing her back inside. After snarling at her through the door for a bit he jumps back over. He has to scramble to get over so that is enough of a head start for her to book it inside, but she is limited to about 10rds from the door.

    The owner put the dog on a chain however he still jumps the fence while on the freaking chain. I told her that shooting it is out of the question now and she is stuck with this annoyance for th time being. In my opinion it's time for a higher fence to be built but of course the renter is not going to split the cost...

    This may be a dumb question but how effective is bear spray or OC spray on dogs?

    She should start spraying the mess out of him every time he wants to come over for a visit. Maybe after a few sprays he would start thinking his yard isn't so bad after all

    She shouldn't be afraid to be in her own yard and the dumbass dog owner needs a shorter chain for the dog. Call police or animal control.

    In most cities its illegal...and dangerous to chain a dog down.
    A chained down dog will get more and more aggressive.
    At this point ...multiple calls to animal control.. until they do something about it...now.!
    Spraying the dog is cruel, if his behaviour cant be changed, and nobody seems to be willing to do that ,then it has to end!.
    If hes that people vicious he will eventually bite someone....to the rescue people ..or put down if nobody wants to put the work in to socialize him.
    To answer your original question...at this point,..legality goes out the window...in my yard ,animal acting vicious, I may get bit ....but one to the center of the eyes....yea Ill let him get that close, command voice to stop.....then whatever happens.

    Seriously, I would say if he makes a move it would be ok to shoot.
    Gun Control is placing the second bullet in the hole made by the first bullet.
