MP5/94 Question

I recently ordered parts kits for MP5 (9 and 40/10) and two reciever flats. I noticed that the parts kit's barrels are obviously less than 16". My question, if I bend and weld the recievers, since there is no serial, does it still require a stamp? If so, how can I do it with no serial?

If no stamp is required, is there anything I need to do to protect myself from Uncle Sam, or does the fact it hasn't a serial proof enough?

The Hungarian AMD65 kits are the same way. The builder has to weld on a longer flash hider to be legal.

If you make an SBR you will need to follow the NFA rules and fill out the forms and pay the tax. When you engrave your info you will will add a serial number of your choosing.

Who would be manufacturer? Can it just be my name (as person not business)?

Also, if I follow this order:

Engrave
Send Form1
Rec'v Stamp
then bend and weld receiver

So in short form, receiver stays flat till I get the form back, would I be free of Constructive Possession?

I would say yes, but I am not the ATF. Seems to me it's like having bar stock laying around. Could be in constructive possession of a nuclear warhead.....

the only addition would be that a serial number is required. If the firearm does not have one, then one must be created by the manufacturer. I had this conversation with an ATF person about making an item from scratch.

Any firearm made after 1968 is required to have the makers name and a serial number on it.
Irregardless of whether you are a licensed manufacturer or an individual.

Also if you build up a gun from parts you are required to send in the federal excise tax for the gun you assembled. ie.ar's ak's etc. cause there was no tax paid on the stripped receiver.
thats why you will see a lot of guys selling ar uppers and lowers seperate in the classifieds rather than the whole gun.
