That was the whole point of NFA '34. President Roosevelt knew an outright ban wouldn't pass muster with the constitution so they put a HUGE tax on them. So they weren't actually outlawed but basically nobody could get one.

And by '86 the tax was economically low enough that an outright ban on new manufacture was implemented, along with illegal registration. Creating an artificial scarcity and outrageously raising the cost of ownership.

and could not be protected under the Second Amendment since they were not in common use.

“The Second Amendment does not create a right to possess a weapon solely because a weapon may be used in or is useful for militia or military service,” stated the appeals court.

The judges said if every weapon used by the military was protected by the Second Amendment, there was little stopping private citizens from purchasing hand grenades
Smells a lot like liberal logic... First, they are not in common use because they were overly taxed then outlawed... you can bet your back side that lots of people would own automatic weapons if that weren't the case... Second, the 2nd Amendment doesn't 'NOT' say you can't possess a particular weapon cause it's useful for militia or military... I get so tired of this lame argument that 'why does anyone need a _________ weapon????'.... Lastly, why even bring up hand grenades????? show me where or when ANYONE has argued intelligently that the 2nd amendment covers explosive devices... uggghhhhh. We are in trouble when Hitlery cheats her way into the oval office...
