NFA items and moving to a new home...

So I think I've got everything squared away for moving. I have multiple NFA items listed in my trust and I want the input of some of you guys to help me make sure I've done everything. I'm moving from OKC to a different city in OK.

The way I read the law, if my trust filed a Form 1 to manufacture an SBR, the SBR does NOT require the engraving modified to the new city because at the time of manufacture, my trust (the manufacturer) was "officingd" in OKC.

Because I have no Forms pending, I simply complete the Form 5320.20 and mail it to the ATF NFA Branch, listing all the items in the trust. I listed "permanent change of residence" as the reason to transport, end date of transport listed as "perpetuum", and "trustee" listed for means of transport.

I don't think I have to change or file anything regarding my trust. Can anyone think of anything I've forgotten?

You are correct. No engraving change required. The engraving is where the SBR was made, not where it currently resides. Just to be technical, your trust was the Maker, not the Manufacturer. A Maker is an unlicensed entity that files a Form 1 to make an NFA item after approval. A Manufacturer is a licensed entity (07/02 FFL/SOT) that files a Form 2 within 24 hours after manufacturing the NFA item. You just need to file the 5320.20. Again, technically you do not even need to file the 5320.20 for an in-state move, but ATF likes to keep the registry as accurate as possible and it would prevent holdups if you ever decide to transfer your NFA items to someone else in the future, so I would do it.

in for the follow. I am moving in the Summer to another state and must do the same.

As I understand it, a temporary or permanent move from one state to another does require a notification and approval from BATFE. There is a form on their website. Number one requirement is that the item is legal in that state.



I'm only submitting the 5320.20 because that's what the lady at the NFA office told me when I called. When I asked about the engraving she replied with "I have no clue"

I'm not surprised. Talking to BATFE is like trying to get a straight answer out of the IRS.

When i moved from Ohio to Oklahoma, i submitted form 5320.20 but never received the "approval" back.

Does anyone recommend what to do?


I would send them a registered letter with a copy of the form you submitted and ask for a response. If they still don't respond, you have proof that they were notified. Or, contact the local BATFE and ask them.
