Good article. I would note that the case he's discussing was in the 3rd Circuit, not SCOTUS, so it's only binding in that circuit; however, he listed several other circuits that have addressed the issue and held the same way, including the 11th, in which Florida is located.

For those interested, a description of the federal court system can be found at http://www.uscourts.gov/about-federal-courts/court-role-and-structure . It's important to keep in mind who has authority where; none of the cases mentioned has binding effect in Oklahoma (10th Circuit), though--as a single-party consent state--it's probably not necessary for us (on those grounds, anyway).

I would say that I agree with you about he school having multiple issues, and they are not improving. If I was the kid's father, I would have talked to the administration to find out exactly what happened and why. I would have then went to the sheriff's office and found out what happened an why. I think at some point, I would have demanded an apology from someone to my son, directly. However, getting up and walking out would not have ended well for the young man.

It would've ended very well for the young man. Every lawyer in the country would be trying to get his case because that's a guaranteed settlement from the school if they laid hands on that student for trying to walk out.

Very well stated. I didn’t have much time when I posted the link, but I wanted to show the growing consensus among federal courts that there is a 1st amendment right to record law enforcement officers performing their duties.

Then how would him walking out ended badly? You're saying he can't just get up and walk out of the room? Badly implies they would try to restrain him because there is nothing wrong with just walking away from that situation.
Badly could imply multiple different consequences. The fact that you believe it could only mean one thing shows that you have no idea what you are talking about.
