I think the issue is, and will be, should this person possess and carry firearms, or should the state make an example of his conduct. I offer this as food for thought.

The defense lawyer could submit this thread as evidence.
He'd say, "looky here judge. OSA is full of smart people and even some of them is confused by this whole new law old law thing. Now looky there at my poor mentally disadvantaged client, judge. He hadn't exactly got Albert Eensteen wrote all over his face now does he? Your honor, my client has decided to put his dumbass at the mercy of the court. He don't wanna go back in there with Bubba and all them friends he's got."

Except that Harper claimed to be the authority, the auditor, was an outspoken member of OK2A. Ignorance of the law is not a valid defense. 1272.1 says what it says and is clear on the issue.

I'm pretty sure "Because Wilshire Gun" is not going to be a good defense....but I didn't get a law degree from inside a cracker jack box.

Is it illegal to carry a rifle into a place where alcohol is consumed? Yes or No?
Did Harper carry a rifle into a place where alcohol is consumed? Yes or No?

I know courts, legal arguments, and rulings can be full of more finesse than that but....

I have never been to Wilshire. Could the club be a leased establishment within the gun club (store) establishment? A seperate entity?

I brought that up in another thread. There is a barrier in place between the range and the restaurant with a single place to enter and leave the last time I was there which is over a year ago.
If it is a separate business entity from the range, it would be no different than walking down the sidewalk past a restaurant that serves alcohol with the front door open?

Just for clarification...No firearms are allowed in the restaurant area at Wilshire, correct?

When i went they ask if you will be consuming alcohol when you enter the store from the street. If you reply in the affirmative, you get a wrist band. That is what keeps you from using the range. I have never gotten a band on my wrist because I have never consumed. I really don't know if they punch it or mark it when you get a drink or not.
I took firearms with me openly in the restaurant area. No one said a word. By the way, the food ain't that great.
