You say it's in OKC limits? I'd call and see if he drew a permit to build a new driveway. Then ask if the inspector has signed off on it since he's blocking existing ditches. I'm not a lawyer, but my neighbor put in a driveway and they wouldn't approve it until he put a tinhorn in.

Would Code enforcement be of any help?

honestly the back and forth stuff has to end because its going to end up with me in jail i already know it. At this point i have to do everything i can to get the city involved because the alternative is jail time and fines.
Does he own the easement for the road? Nope. city does so he can not send you to jail for making proper engineered improvements and proper drainage is proper engineering.
What road is this anyway? Location and name?

Please consider getting a lawyer, or at least a written legal opinion, before doing anything outside of your own property at this point. Safeguard yourself as best you can.

at some point it might be worth a bit of time and money to have a lawyer get involved. Either to read the ownership agreement for the road and/or send a letter to the guy. Making him shell out some $ for a lawyer (or the thread of needing to) might sway him a bit. Even the idea of going to mediation.

perhaps it's not the route you want to go, but have you inquired if the city could take over the ownership of the road? Might be a political issue, but that'd at least allow for more clear guidelines.

And, as CHenry mentioned, i'm sure there is some kind of easement involved somewhere, so likely some group has a stake in the matter (even if the issue is maintaining the road to access other areas, like the highway easement)

Private road, not a city owned road, so city won't do squat about it. That is the problem he is having, no one seem to want to get involved until its too late.

What you aren’t getting is that I would work my nuts off and spend a bunch of money to fix it only to have him come and destroy it again. My temper cannot take another series of this it is the exact thing that has already happened and he will do it again. I have to go through the City or if that fails then the court system.

Even though it is not city owned it is still in city limits and every type of construction has to be done up to City code. I went through this when building a storage building it was a nightmare. I am hopeful the same thing will happen to him concerning this.
