I am new to firearm.

I am planning to get a complete AR 9mm Pistol.
It has 5" barrel. No stock but only brace / stabilizer with buffer tube, and no vertical grip.
So this should be just Pistol but not SBR.

Do I need tax stamp / NFA if it is a AR Pistol in Okahoma now?
All I need is ship the firearm to FFL and do a background check. Is that correct?

I have been looking answer in the forum but it was dated back in 2012 and says Tax Stamp is not required.

Thank you guys.

Like “Ignored Member” said. If it’s a pistol and you put an arm brace on it it is still a pistol. If you buy a rifle and you shorten the barrel less than 16 inches then you would need to file an ATF text them first.

So as long as you’re buying a pistol and put a brace on it in Oklahoma you’re good to go without having to pay any federal fees.

This is why AR 'pistols' with a stabilizer brace have become so popular. I have an SBR, took me like 10 months to get my stamp. I've considered building an AR pistol, but I really don't like the stabilizer braces much, so I have held off.

But bottom line is, if you don't attach a stock OR a standard buffer tube that can accept a stock, then it is still classified as a pistol. If you EVER take that pistol tube off and attach a standard buffer tube to the lower receiver, it is forevermore classified by the ATF as a rifle, and my understanding is, if you even do that for 5 minutes and then go back to a pistol buffer, you are in violation.

The new adjustable SB Tactical pistol braces come with the exact same buffer tube that an adjustable stock would use . . .

So my understanding (albeit several years ago) was that they looked at the TUBE as though it 'could accept' a standard adjustable stock, so it was the deciding factor. That may be out of date, obviously. I haven't looked into it in several years.

I think if you give one of them a try you won't be disappointed.

My current understanding is that:
* Brace and a barrel under 16" = Good to go
* Brace and a barrel over 16" = Still good to go
* Stock and a barrel under 16" = MAJOR FELONY
* Stock and a barrel over 16" = Also good to go.

Also, the last ATF Guidance I saw regarding braces is that as long as they are not modified from their factory configuration, they can be "occasionally" shouldered and fired from that position. How one determines that was not made clear, but in theory, you shouldn't go to the big house just from popping it up to the shoulder and taking shots. Were you to modify anything on the brace it would show "constructive intent" though which would make it class as an SBR and require a tax stamp.
