Is this legal or not (SBR type question)

So, let's say you have an AR "pistol" with a buffer tube sticking out, not a registered SBR.

If you take said weapon and place end of buffer tube on your shoulder and shoot it, using the buffer tube as a buttstock of sorts and sighting with a cheek weld on the tube, is this legal or illegal? In other words, do you HAVE to hold a pistol at arms length and shoot it with one hand to be legal?

do you "have" to hold your glock 22 with one hand at full length for it to be a pistol?

Is a rifled shotgun a shotgun if it has a rifled barrel and shoots slugs?

No, you can put the tube to your shoulder. You can't put a stock on the tube though.

From what I've read, you can have a standard tube that can accept a stock. BUT, you can't have an extra stock laying around that goes on that tube or you could be in hot water for constructive intent. If you have an actual pistol buffer tube you are completely legal. It doesn't matter if the tube happens to touch your shoulder. It probably won't be very comfortable anyway being so short.

I've always wondered. How many cases of "constructive intent" other than Thompson Center have ever been charged or been to a court. If I recall correctly, they weren't charged. They got crossways with BATFE and sued them.

How many cases of or "magazine capacity, flash suppressor, pistol grip, bayonet lug or any of the other "evil features" were ever charged. Even during the assault weapon ban. I've never heard of any.

There was a guy in florida recently that got busted for constructive intent. They threw out the charges.

I agree with you, but it would royally suck to have to defend yourself in court from the government.

If you own ZERO lowers whatsoever, you can own all of the SBR uppers you want. If you have regular rifle lowers and an SBR or pistol lower and all of the rifle lowers have rifle uppers you can own as many SBR uppers as you want.

There was a guy in florida recently that got busted for constructive intent. They threw out the charges.

I agree with you, but it would royally suck to have to defend yourself in court from the government.
