You had to go and say that out loud now didn’t you? That is the stuff nightmares are made of.

Don't think for a moment the Democratic party isn't drooling at the thought of picking up a couple Senate seats in Nov. and then stalling the process for 2 more years, in the hopes they can reclaim the White House. They know their BEST bet with Trump in the top seat is to land a moderate, but that isn't enough for so many of the rabid snowflakes out there.

Pray someone gets confirmed before November. Pray. Pray HARD.

Dennis, you're buying into this idea that the 9th circuit court is over ruled routinely . What exactly does that mean?
Fewer than 1% of the cases decided by the 9th circuit are ever even heard by the Supreme Court. The rest are allowed to stand.
Your sources tell you that the 9th circuit is reversed "almost" 80% of the time? What's 80% of 1%?

To evaluate this claim, we turned to SCOTUSBlog’s Supreme Court statistics archive, specifically their Circuit Scorecards, which track how often the Supreme Court justices agree or disagree with the lower court decisions.

The Supreme Court hears cases from the 50 state courts and 13 federal appeals courts, known as circuit courts. The cases that the Supreme Court chooses to take on are often disputed among the lower courts, complex, and problematic, so there’s a reasonable chance that the Supreme Court will decide that the lower court’s decision was wrong.

In fact, the Supreme Court reversed about 70 percent of cases it took between 2010-15. Among cases it reviewed from the 9th Circuit Court of Appeals, it reversed about 79 percent.

It may seem like a minor point to you, but your article states that it reversed 79% of the cases that it took from the 9th circuit. It only TOOK .5% of the cases decided by the 9th curcuit
Meh.. 79% or 80%, whose counting anyway?
. So what's 79% of .5%?

Another fun fact: the second circuit was reversed 100% of the time in 2014. Holy COW.

Also keep in mind that SCOTUS selects its own cases; given the huge volume of petitions for cert, and the Court's limited time, it's generally not going to waste time hearing cases with which it agrees. To get selected, you generally have to have one of two things: a case the Court thinks is wrong, or a circuit split (two circuits reaching substantially different conclusions from substantially similar facts). A distant third is one the Court thinks is ripe to be overturned, such as the recent out-of-state sales tax case.

There was a Suprem Court opinion I remember from a first year intro to WestLaw presentation, which I believe was authored by Kennedy, but demonstrated a very Scalia-like wit. If I recall correctly, the opening two sentences were: “This case comes to us on remand from the Ninth Circuit Court of Appeals. For this, and other reasons, we reverse.”

I have been unable to find this and would to read it again.
