17 but there are some that I know don’t pay.

So if they don't pay, I'm guessing this is a voluntary HOA? I saw someone posting about one of those once... they went on this long lengthy ramble about why people should voluntarily cough up to cover this and that and blah blah blah. All I could think about while skimming over her diatribe was how many HOAs across the country pull sh|t like this and trying to keep people from flying the American flag.

Look at your deed for your house. Should be with all your paper work including a copy of the HOA documents. The drawings will show you where your easements are on your property. All that was laid out when the addition was being built. My last new construction home was in Skiatook. Only time I have ever dealt with an HOA. The scam on it was the builder that owned all the lots put in the HOA that he had 6 votes per lot that he owned till the addition was completed. All the HOA did was pay to mow the overflow pond he was forced to build to make the city and county happy. The rules were rarely enforced unless it benefited him.

My current home is in an older addition in south Tulsa with large lots. They have a voluntary HOA. Its an absolute joke. Just like covenants, once they are broken a precedent has been set. People get bent out of shape on occasion about stuff. My addition originally had shake or wood shingles. The covenants I was given when I moved in stated no asphalt shingles from 40 years ago. LMAO over 99% of the homes now have asphalt shingles. So unless someone gets all of us to replace our roofs the rest of the covenants mean squat.

Here is a check off list
1) Check abstract for HOA covenants
2) Have they been amended (Check with HOA officers and get copies)
3) Check plat plans for Easements for Utilities (Public and/or Private)
4) If you are in the city limits then you are bound by city code
5) Is Vyve a Public Utility or a private business
5) Ask HOA Officers for copies of the following
1120-H (HOA Tax Return)
Yearly Treasurer Report

Not all easements are city or county. I have drawn, read, and looked at a few thousand plats, deeds, and other legal documents for the biggest part of my life. I can tell you that the landowner/person putting in the addition will allow the utilities to use the easement, but the rights of the land is still whoever owns/manages the land. Its a "agreement" that the utilities companies, city or county have with the landowner to put in utilities to have power, water and sanitary sewer. Most easements in housing additions are not owned by a city or county. If its an pipeline its more of a lease with a one time payment to the landowner/mineral rights owner at the time.

Well now I have a new wrench to throw in. I talk about it in my shooting backstop thread. But here it is. I got a visit from the sheriffs deputy about an hour ago. A neighbor called them and said I was shooting. She lied to then and said I do it all the time and she is afraid to let her kids out. Even though her house is over 250 yards away to the east past a creek and woods. Then I am told the pathetic HOA president talked to the deputy and said he has received several complaints from neighbors about me shooting. Even though there are people around us through the woods that shoot all the time. The president said they are gonna have a meeting with all the residents about stopping me shooting. Then the cop precedes to tell me I am breaking the law. I said “ the two deputies that came out last summer specifically said I wasn’t breaking any laws and that I could continue to shoot as long as I was safe”. He said well we just overlook it. I said what law am I breaking. He said” it is not a county law but a state law that says you can’t be within 220 feet of a dwelling that is not on your property. He then preceded to tell me he wasn’t going to arrest me but that he could. Then he tries to tell me how big a 2A supporter he is. He is the type of cop that would confiscate guns I guarantee it. He was trying to play both sides. Seemed to me like he was trying to be nice but at the same time trying to scare me into not shooting. I have never heard of the law he spoke of and have asked several people including police officers. He knew the guy I bought my house from who is a cop and I told him he used to shoot all the time. He was the one who put the dirt pile in I used to shoot in before I built my new one. And he never got the cops called on him. But it’s different for me beside I’m not a cop. These people are really ticking me off. I don’t shoot that much and when I do I try and only do it when no one is outside. Especially the kids. I try and be a good neighbor. They can kiss my rear. I won’t ever pay another cent to that worthless HOA. I am gonna request the financial records to which I have never been shown. Heck. I wasn’t even given a copy of the covenants when I moved in. And my friend just moved in around the corner and he didn’t get them either. Nothing is ever done to improve the addition. The only thing that gets done is the road gets grated by the HOA president. And that ain’t very much. I have also seen him bring in a couple loads of gravel to spread out. That is it. We discussed building a sign for the front and landscaping and it hasn’t never happened. We pay money for nothing. Guarantee the president is skimming money.

I forgot to mention the president and his wife came down to my house earlier to deliver the ballot to vote for Vyve. His wife wrote up a letter that said “ Vyve broadband has requested a vote to allow them to install cable in the addition. Each yard will have a pedestal installed. Then it said if you aren’t current in the dues you can’t vote. He was supposed to be getting brochures to take around as well as a letter form Vyve stating what they were wanting to do. It instead of him waiting he rushed into making the ballots because he didn’t want anyone to see what Vyve has to offer. I don’t trust the vote. Even if enough say yes I think they will lie. I will demand to see the votes. HOA’s should be illegal.

If the HOA was disclosed in the home listing, the contract at closing, and the deed records... you'd best pay or they'll lien up on your property. You don't want to to down that road.

Especially since you've seemingly already gotten on their bad sides.

Especially since you've seemingly already gotten on their bad sides.
Since they aren’t doing what they are supposed to is there a way to get out of it?
