Not sure where the confusion happened, but I believe I did put forward a scenario like that. And based on the conflicting news reports, we don’t know what happened. I always prefer to think of plausible justified explanations for someone’s actions before assuming the worst or most likely explanation. I wasn’t trying to trap you or anything. Just honestly wanted to understand your point of view. I’m sorry I rubbed you the wrong way.
Time was, and I think it was before Castle Doctrine really came into being, we were taught that if a suspect was running away from you, they were not to be considered a threat, even if they were still within one's home. Only if the suspect was running, was shooting back at the homeowner, and possibly that one could definitively prove that they were shooting as they were running, could one be comfortable in saying they were shooting in self defense. Otherwise, if they were retreating, it would be hard to prove they were threatening, especially if the home owner/apartment resident had no other witnesses confirming the suspect was shooting back.
I'm proud of the kid. I wish he could have been a better shot and killed them all.
If he is IN THE HOME, he is a threat.
If the guy turns his back just as I pulled the trigger OH WELL. He did just pistol whip my Dad ya know.
