I believe you are wrong, at least from what I read and was told by the ATF Agent. When you have a tax stamp weapon the ATF has the right at any time to show up and request to see the weapon and make sure everything is secured and in your possession.

I had to change the address on my SBR 6 years ago. I got it after my Dad passed away and didnt even know until I was talking with a ATF agent. You are only required to notify the ATF, the state of Oklahoma doesnt need to know at any level unless you just want them to know.

So I am on the hunt for a 9mm suppressor that will work with some of my Sig Sauer 9mm handguns along with my Sig Sauer MPX and my CZ Scorpion Evo 3. So this can will need to be able to mount to a pistol and a pistol carbine.

There is no way a dealer is going to give me my money back on a Class 3 rifle that I have attached my optic on, my suppressor QD along with shot 300 rounds thru it just because the ATF is taking their time.
So I bought a new SBR 10/2019, did the electronic process at the dealer and everything was cashed by the ATF by 10/20/19. Dealer said it would be 4-7 months at that time based on previous Form 4's.
Then Covid hits, so I let it go for a bit. I just called to poke into the process last week...
When we added another Class 3 item to our Trust the ATF made us send in a RPQ form for every person and finger prints for every person.
Also based on the current laws, even for the items not in the trust a family member can take them over just fine. They can even get a new stamp in their name...

You cant legally do this either. The person on the Form 4 has to keep possession of the Class 3 item the entire time. You are also required to notify the ATF when the address on the Form 4 where the Class 3 item resides changes as well. Failure to do either of these can result in the Class 3...
There really isnt much use to the Trust option anymore. It doesnt avoid any paperwork and actually requires more paperwork when you add new items under the trust.
Kind of hard to "full recall" a gun if the owners refuse to send the gun into the manufacture for the repairs. I have several P320 guns and on the one that was affected Sig threw in all sorts of goodies to entice owners to send the guns in for the repairs.
As it is now, you still dont with or without the trust. Originally it was a way to avoid the background checks but now with the loophole closed the RPQ has to be filled out for every member on the board any time a new Class 3 item is added to the trust.
