At this stage, the Dems don't have much choice. Hilary has bank on the basis of name recognition alone (typical voter: "Oh yeah, I know who this is! Dunno about the other(s).") Bernie may be catching up in the polls, but right now he's too much of an unknown for the bulk of the country. Better play it safe and pander to the lowest common denominator.

Yeah, but in a general contest with a republican, every point counts. And if she loses several points because she(finally) is convicted of being corrupt, that might lose her several vital states. 8 republican years might mean she is too old to run.
If they wouldn't pursue Lois Lerner's crimes, they certainly won't pursue Hillary's.
Yeah, but the IRS was able to destroy the evidence. And although the top justice department officials are under the obamite thumb, the lower and mid level management are probably real americans.
