to make it legal, the flash hider attachment can't be temporary, it must be permanent.

Also, be careful with that upper. Some folks have gotten in trouble for constructive intent. You should get a pistol lower quickly or give it to someone to hold for you that has a SBR or pistol until you get your stamp.

There are 5.5 inch flash suppressors available, but they thread the better part of half an inch onto the barrel. You would need something longer than 5.5 pinned and welded to cover you.

Yes, remove the 10.5 and add a 16

temporarily making the barrel longer is not legal. Without an SBR or pistol lower, you're asking for trouble. It's neat to put on and swing around tac-style, but not worth the felony.
you can get a decent 16" barrel for 100-125 and put it on the upper til you get your paperwork. If you decide you don't want to do the SBR, you can sell the short barrel and recoup the money you spent on the 16". If you get the SBR, you can sell the 16" and recoup the money after you get your stamp.
or trade off your 10.5 upper for a 16 upper, or, or, or...
there are many ways to do it legally, just take care.
