Sucks. Oddly I try to avoid doing business in CA about as much as I do with things made in other counties. This has happened to me with other companies and I call my credit card company and file a protest. I explain the breach of contact and let them know ill take the goods with confirmation of shipment. The company shouldn't charge your card until the goods are ready to ship anyway.
In your case the breach of contact is not meeting the agreed delivery time.
I got into a similar deal with DTT transmissions, supposed lifetime warranty, they waited until the time to cancel the credit card payment had passed then told me to go pound sand, I talked to an attorney who said I would probably win a case against DTT but the court case had to be held in the district the deal took place, about 250 miles away, he said even if I win I would probably spend as much or more on travel & attorney fees than I would be awarded.
