Sucks, but it looks like that's the only viable option.

Make sure you bury him away from the property line. It would suck for an earthquake to move him out of compliance.

He legally can't do anything with it besides destroy/dispose of it. You would have lost some more chickens, but you could have kept catching it, open the door and let it run out, and kept catching and recatching until December 1st lol. They're not real smart, I caught the same female 3 times one season. Her right ear had about a half inch split and was easy to recognize.
