It is silly. But yes, that is a “pistol” lower and would transfer as such on the 4473.
An SBR is an NFA item, and another ball game. But basically, yes.
You would transfer it as a “rifle” to yourself on the 4473, then register it as an SBR with the ATF ($200 tax and ~9mo wait).

being this is a "pistol" lower and it would go with a 10.5" Upper, is it legal to shoulder this? or can it only be used as a forearm brace? Or both? Or once you shoulder it then it becomes a sbr?

ha thank you, i was just reading that before you posted it... i think it clears it up. the answer is yes you can, as long as you do not modify it and it is indeed a stabilizing brace/ arm brace..
