After around 40 minutes on hold I got in touch with palmetto, it took quite a bit of arguing because they were not comprehending what the issue is. They sent me a label and are taking a look at the upper.

NOT normal. Someone didn't clamp the upper correctly when they installed the barrel...... It's probably over torqued too.

Resolution here. I mailed the upper to them (I stripped it down and moved the barrel to a slick side upper). About a month later I got a large box with a new upper in it, I'm pretty happy I got a new one but there was no communication just randomly a box with packing paper and an upper.

Probably a way to get around admitting something was not right. Perfectly understandable.
