In cases like the OP , Loss of truck and all property used during the crime.
Garnishment of wages.
Weekend community service
Loss of any socialism benefits, assistance.
Pay resistition for each and every deer poached ($10k each, min)
Loss of hunting, fishing and gun possession FOR LIFE.

Some poor guy shooting A doe, to feed his family is NOT the same as his jacked.

BTW; the cost to incarcerate is closer to $75k / year.

What about them poor pigs that run wild. Do you all care as much for them? They got a right to life. How about that spider you stepped on the other day? I mean shouldn't we care about all life. Amazing that people worry about animals when we have so many problems in this world. And deer can go extinct as far as I am concerned if we can raise cattle on the property. You get more and better meat.

meh, state overreach.

there are people who literally believe that deer wouldn't exist if not for the state management. while people won't even get in their cars and drive thru, just pay someone else to do it, somehow everyone with a gun is going to go just blast fiddy deer.

oh yeah, and they all carry covid. let's hope the State doesn't take action then! rip to the 17,000,000 dutch minks killed for covid last year.

Who would restitution be paid to? Just curious.

The State

Same as all fines
Oh, Okay. A fine. Cause the states don't own the animals. So what would a 90K fine mean to him? think he'd ever pay it? And by the way, I don't know the answer that would be an effective punishment on people like that. It only penalizes someone who has something to lose. How do you punish someone who doesn't?

This reminds me of a vacation I took many, many years ago to the island of St. Kitts in the West Indies. While going through the town square, we noticed all of the freshly painted rocks/buildings and no trash to speak of. There was a large pile of twigs/sticks/wood too. I asked our guy at the hotel and said it was all done by inmates. Plus, they had to cook their own meals on wood fired stoves. Don't recall what they were given in the way of food but it sure wasn't extravagant. Their sentences had no leniency either. One guy was convicted of hitting his wife. He got a 1 year sentence. Not 364 days, not 366 days. Nothing like time off for good behavior but they WOULD add on time if unruly. Inmate told the guy at the hotel he'd never get arrested again as it was unbearable. BINGO!!! That was all the rehabilitating that was required. Too bad as a society that's deemed cruel and unusual punishment. SMH.
We went to ST Kitts as well and found the same intel from those we met on the island. It doesn't take much to get some time behind those steel doors just down from the resort we stayed at. Our boat captain said cursing in public might get one a weekend in the slammer. We felt very safe there.
So, from a firsthand experience with poachers, I was told that all wildlife violations in OK are misdemeanors. Repeat offenders may lose license, vehicle and guns, they don't get jail time unless they don't pay the fines attached to the violation.
Thats where they get them behind bars. There can also be trophy fee fines attached for poaching a big deer/elk or whatever.
We live in the country. Leaving home to go to town one morning, I spotted a pickup driving erratically with two guys heads looking out into the wheat field. I spotted a dead buck out there about 200 yards away from the road. They acted really scared when I passed them. Drove to the next mile that is uphill, got out of sight and pulled over to glass them. Very few vehicles in this area. One guy got out and started towards the buck.
Called Osage county GW Larry Green that lives about two miles away, told him of the situation and he was on scene in minutes. Pickup went by, GW did a traffic stop on him and found two fresh killed bucks in the back.
The investigation found he had been poaching for years. Pics from his phone were matched to locations where the kills happened, DNA taken, and matched to racks at his home. Big time fines, etc, and he did go to the slammer for nonpayment of fines and other outstanding warrants. Stayed behind bars for over 90 days, and was released on an OR because they were tired of supporting him. Osage county deputies were waiting at the cell door to arrest him for nonpayment of fines for poaching in that county as well as outstanding warrants. His rap sheet is 10 pages long with domestic violence, theft, and so on.
Meth head that doesn't sleep for days so he drives country roads and shoots deer. After his jail time about a year later I was helping a shooting event for ladies around Kaw Lake. Met up with GW again, and was told the guy was back out poaching, back on meth.
These people use poaching not to get some meat, but to get a rack to brag on.
We have people in the county where our farms are located that poach for sport and bragging rights, and that's stealing from honest sportsmen and women.

Dennis, this is what I'm talking about. they didn't get any money out of him, ended up spending money to detain him and he got back out and was back at it again. What was the point of it all then? He learned absolutely nothing. Those are the ones I'm talking about. He's out nothing but a little time. He'll continue to shoot them as he always has, probably using a stolen rifle, in a truck he gave a few hundred for and stopped paying on. There are truly hopeless people out there and he personifies that.
