Heien vs NC
Ruled 8-1
The Heien opinion holds that the police can act “reasonably” even if they don’t know the criminal law but then says that no private party can act “reasonably” if he or she makes the same mistake. That dichotomy implies that the police can break the law, but members of the public cannot, a double standard that is offensive to longstanding American values.

Glocktogo stated this earlier in a post about Mueller and his witch hunt.
The prosecutor can lie, but the subject of the prosecution cannot. Hence the perjury trap that is being used to get Flynn, and others.

correct-ish, 2 different case laws

It’s the same as in any other investigation. There are a ton of average joes in the pokey for lying/misremembering to investigators. It's pretty underhanded, but legally fair game, so LEOs will do what LEOs do. I’m sure many of our resident LEOs have lied, participated in a ruse to trick their suspects, or grilled them long enough for their story to change. What’s good for the goose is good for the gander.
