Open Carry Question

    Buddy and I were at the bar last night drinking a few beers and discussing guns. He posed me a question.

    Can a person who lives in city limits AND has the open carry license carry their pistol openly ...on their property...in a neighborhood addition?

    There are no schools, churches, state or federal buildings, liquor stores...etc....with in a mile of the neighborhood addition.

    They stay on THEIR property but open carry.



    My answer: Yes, being there are no restrictions and you stay on your property. It wouldn't be a wise act ...letting everyone know you own guns and neighbors might call police...but show them your ID. It would be legal, the neighbors might not like it but it would be legal.

    My buddy: He thinks it's illegal to carry on your property in an urban neighborhood.

    I asked him what the difference was when people carry in different stores in cities...without a non carry sign.


    He didn't believe me



    Am I correct? Own property....no restrictions within several miles...urban neighborhood.

    Two beers are riding on this bet.

    If you have a license you can carry anywhere other than the places still restricted like Gov. offices etc.
    AND if you dont have a license you can still legally carry on your own property.
    Also it doesnt matter how far the nearest school is as long as you dont set foot inside one while carrying.
    Liquor stores are legal to carry in unless they have a posted sign.
    You win the bet.

    Open carry is legal in public in Oklahoma, provided you have an Oklahoma Handgun License.

    Open carry on your own property also is legal in Oklahoma, even WITHOUT a handgun license, if I remember correctly. State law has preemption, meaning any ordinance a city tries to pass to restrict such would be null and void.

    It may be one of the laws getting changed in Nov, but the president of OK2A gave a speech at our monthly gun club meeting saying that long guns are different than hand guns.
    One of the differences he talked about was if you openly carried a long gun across the street to show your buddy in an urban area, you were guilty of a misdemeanor. He cited the case law, that I didn't get notes on which it was.

    This. A handgun license will cover both OC and CC.

    On the same subject...can a state that has reciprocity with Oklahoma use their states license (say, TX, for instance) to Open Carry while they're in OK?

    TX is an open carry state I believe so that would be a yes. If the home state was concealed only, then believe that governs but I'm only speculating.

    My understanding is that they can OC or CC in Oklahoma with a carry license from another state.
