Ask Bob Macy, former DA in Okc. Home owner actually chased down a guy he caught breaking into his home and shot him at an intersection a mile away. No charges filed.
We had a thread on here several years ago that went on for many pages about shooting someone in the back as they were running away after breaking into a home. Some of our legal experts in real life cited some cases where that actually happened and no charges filed.
There has to be some really extenuating circumstances for that to happen though.
It also depends on the political beliefs as DA’s in Ok are elected politicians. One may charge, the other may not.

There are many questions that people would like ask Macy except he is long dead.

And I agree with him the people that do those type of things are of no value to society. Need to teach them this behavior will not be tolerated
