OKLAHOMA CITY (AP) — A Native American man convicted in Oklahoma of first-degree murder and another who pleaded guilty to manslaughter had their convictions vacated.

The moves came after the U.S. Supreme Court ruled Thursday that a large chunk of eastern Oklahoma remains a reservation on which tribal members are subject to federal and tribal law, but not state law.

Joe Johnson Jr. had been serving a life sentence for a fatal shooting in Seminole County.

Travis Wayne Bailey had been serving 36 years in prison for killing a man in a vehicular crash while intoxicated with methamphetamine.

Two convicted sex offenders also won new trials after the landmark ruling.

I will sit back and see if tribal law does something with these people.
If the land was given to them by the Federal gov and then the State took it away ..I will bet the state did not take it fairly.

Was there a fair agreement with the Indian tribes or were they forced to give up their land and rights.

You can't take something by force and always get away with it.
Yea those prison guys did bad things and should pay a price I agree with that but sometimes crap like this can happen.

The more I read about this ruling, the more I believe that is was a correct application of the Constitution. You know, that thing that has the Second Amendment. Sometimes our wishes get in the way of true application of the original Constitution. The US has made a good number of decisions that were not in agreement with original intent, and corrections must be made.

As screwed up as this is, I'd have to agree.

While we're at "correcting" stuff, let's boogie on back to the Fed Res creation, and most acts during the FDR administration. Feds controlling public schools, dictating regulations for individual states....you know, all that stuff they should not be doing.

Well, we have a good example of how to go about it. Those issues just haven't raised enough interest to carry through the legal steps. We have a great Constitution, and a very large number of good attorneys that have the knowledge, all that's missing is enough interested parties to carry the water.
