Which insurance company?So..... I'm in the thick of this right now. 2+ years ago I told the neighbor I was worried about his trees falling on my house. Last week, sure enough, a limb fell and took out the power pole and part of the fence.. The neighbor and I get along pretty good, he was over the next day and cleaned up the limbs and he is repairing the fence himself. I called the electrician he recommended and the power is back on.
I spoke to his insurance "agent" and she was a *****. One thing led to another and she denied the claim.
"The tree that caused the damage to your property had no obvious health conditions prior to the loss. There was no prior notice of concern from any outside parties. Therefore, we must deny your claim for damages resulting from this loss."
At this time, I'm pretty sure he is going to pay for the electrician anyway. I have extensive documentation of everything and tons of pics. Just in case....

Neighbor behind me took out some Cottonwood trees in the easement that irritated the neighborhood and while He was at it had the crew remove a good sized pine tree also in the easement that a widow lady had planted and nurtured for over 10 years. She didn't want trouble so she didn't say anything but it was rude, and a slap in the face to the widow even though it was in the easement. I would have challenged him on his actions.
It’s a matter of who is allowed to cut things down in an easement.What if the power company or any other utility had cut down the pine tree?
If It is in a easement it can be removed at any time, therefore do not plant anything or build anything within easement you do not want torn down, cut down or moved
Most all platts have building set backs clearly marked, stay within those lines for anything you want to keep.
