Something that's almost certainly irrelevant: if it wasn't known to the shooter at the time of the incident, it couldn't possibly have influenced his state of mind as to whether or not the decedent presented a threat worth shooting. His violent actions, sure--and it may have been a legally justifiable shoot based on that. I won't argue that.Whats this?
Read the story for the context:Dave, the shooter did not walk up to the car and shoot somebody for illegally parking in a handicap spot, so the dead man isn't dead because he parked there......he is dead because he assaulted the shooter, period! The shooter did not draw his weapon until after he was assaulted.
If you watch the whole video, you will see that the shooter never talked to the dead guy before he was attacked......so there is no way he shot because the guy because of where he parked.

That's another question entirely. I can see it if there's disparity of force (particularly if the shovee-shooter was injured or frail, whether known or not to the aggressor), and I don't presume to know Florida law, but under Oklahoma law, I don't see a felony battery or grave threat here. But I didn't want to opine there because the legal issue will turn on the text of the statute and the local jurisprudence interpreting same, and I don't do Florida.So put the whole handicap illegal parked car and argument aside this guy comes up to the hero and shoved him down then the hero shoots the guy then is it justified?
This might wind up being a legal shoot according to FL law, but it's not a justified shoot IMO and certainly not a "good" shoot. I'd hate to think I wound up killing someone over something as trivial as a damned parking spot.
Because we generally require our "good guys" to respond proportionately. Killing somebody because of a shove isn't proportionate (in most cases).Who parked where doesn't make a damn really. Don't put your hands on somebody unless you're willing to die. The guy got shot cuz he got physical. Why can't someone call someone out for parking in the wrong spot?? Several have mentioned the older fella should've let it slide. Why didn't the dead guy just let it slide?
