homicide, NOT murder

Not murder

We'll see if it's homicide or murder. You can't possibly make a rational or accurate judgment from that video.

This is the problem with social media...everyone's out to make a judgment call on these things before they know any relevant information. We gotta have everything right now. Nobody's got time to be objective and look at all the facts before passing judgment.

EVERYONE reading this knows what the problem is, NO ONE reading this, is willing to say the words, right? Is that scary or what? Black kids in this country are subjected to a literal BARRAGE OF HATE PROPAGANDA, 24/7/365 from birth, against ALL WHITE PEOPLE! This is done by Democratic Politicians, and their lap dog news media, in an effort to get black Americans votes! Politicians by their very nature, will use any means at their disposal, fair, and unfair, to get elected! The side effect of this is, BLACK AMERICANS HATE ALL WHITE PEOPLE, no matter what they say! You saw how this crowd attacked this kid, like a pack of cur dogs!!! I seriously doubt this kid ever owned a slave, yet he was being blamed for all the injustice of THOUSANDS of years of human slavery, that went on before human history was recorded!!!!! Like all Muslim people are taught from birth to HATE ALL JEWS! If this HATE ever changes, it will have to start with what these kids are taught!!

Was there a racial difference in this incident? I couldnt tell from the video as it looks like portions of it were blurred out.

But to address the question of whether deadly force was justified - id agree with everyone else who said

"It depends" Not being familiar with this outside of this thread, i dont know what the buildup was or whether victim 1 (the stabber who was getting the beatdown) was an antagonist or what

A lot of folks are killed every year with hands and feet though. So potentially deadly force was being used against him

No. The stabber was a black 14-year-old named Tyquan General Jr. Both the stabbees were black as well. The guy who can't spell "radio" is playing the race card when it doesn't apply to the situation.

Young Tyquan has been charged with murder as a juvenile. That may be subject to change as the investigation progresses.

I have no idea what started it alll. That matters and may change things.

Based on limited info I have, I’d charge the mob with manslaughter or murder.

The context of a school, church, or shopping center should be irrelevant to testing whether the threshold for use of deadly force as an act of self-defense was justified.

As I understand it, an assailant cannot claim self-defense, so who was the assailant?

At the start the video depicts two youth engaged in a physical confrontation. The individual on the right strikes the one on the left. The party struck flees into the gymnasium and is perused by a group, is knocked to the ground, and kicked by multiple people. While on the ground the party struck begins making stabbing motions at one of the parties kicking him and as soon as he can regain his footing flees again.

We don't know what happened prior to the first punch on video, but it appears that the individual on the right did not start the confrontation and had minimal flight paths prior to being punched. The information available does not indicated he was the aggressor or began the physical altercation.

Based on what was recorded, the kid who did the stabbing is the one who was assaulted. What we don't know is what transpired before the video began. It appears to be a cell phone video. That means someone became aware of the altercation and chose to film it. We don't know if the fight was premeditated, and the videographer was there as a knowing observer and caught the whole thing or if the heard a scuffle and began filming mid-way into it.

Regardless of how it began, my understanding is once the kid fled, his pursuers became the aggressors, because they chose to continue the confrontation. Its not much different than a storekeeper shooting a thief in the back as they run from the store. In most places self-defense does not allow a person to peruse.

Also, if the party stabbed was not part of the original scuffle, and rather one of the secondary assailants who joined in after the scuffle moved into the gym, they are unquestionable an assailant.

So regardless of how it began and where the kid with the knife was on spectrum of angel to devil, it appears he was the assaulted party and had a right to act in self-defense.

Multiple aggressors on a downed party, I would say the threshold for serious bodily harm had been met.

I think if the same basic scenario occurred in a casino parking lot to an elderly woman. and she came up with a handgun, no one would question the use of deadly force.

I agree with all of the above. Except for one thing, we live in an age where a kid can get expelled for making a pop tart into the shape of a gun.
The no tolerance stance on weapons can be taken to the extreme.

So-called "zero tolerance" rules are BS, but that being said, they're just rules. Sure, expel the kid but the mere fact that the kid had a knife shouldn't be a deciding factor on whether he's criminally liable for aggravated assault or murder, absent proof of motive and intent prior to the altercation.

Self-defense is self-defense, regardless of where it happens. As others have posted, we don't know how it started, but a 3-on-1 pursuit of someone fleeing followed by a 3-on-1 beat down weighs heavily in favor of the pursued kid.

Sorta reminds me of a recent case of a young man set upon by rioters, killed one and shot a skateboarder in the arm. Charged with murder but found by jury to be self defense.
