The issue at hand is the creation of federal records. The procedures for the creation, handling, and storage of those records are codified in federal law.
By law, electronic messages that are created and received in the course of conducting government business are considered federal records, even if done on a personal cell phone via a personal account. This includes texts, tweets, and instant messages. There is currently no “system” to accurately capture and archive all of that info from a personal phone...hence most federal agencies just prohibit the use of personal phones for government business. It’s easier.
Then there is the security issue.
If it wasn’t cool for H or O to do it, it’s not cool for Trump to be doing it either.
