Confused

Was at the local c-store just before 2 am. While there a guy who was drunk pulled out and hit my truck. Police were already there on a different call. They saw him try and leave after he hit it . He was placed in cuffs and put in the back of the squad car. Then after about 25-30 minutes they uncuff him and let him get in the car as a passenger and let him leave. This after the officer told me he was drunk. I am so confused about this.
