SUMNER COUNTY, Kansas – Sumner County authorities say they have arrested a homeowner accused of shooting two intruders on his property early Monday morning.

Investigators believe the shooting victims had broken into a home near rural Milton. The homeowner, a 46-year-old man, allegedly shot the two men, hitting one in the face and the other in the back. The homeowner was charged with aggravated battery, posted a $1,000 bond, and released.

"You cannot use deadly force to protect property or if someone's running away from you, not being a threat to you," said Captain Mike Yoder with the Sumner County Sheriff's Department.


Doesn't this differ from Oklahoma's stance if on your own property?

I have had SO many officers tell me to be sure and drag them inside after. Don't know for sure. I'm not planning on shooting a bad guy in the back, outside of my house, running away. I think I can live with killing to protect my family, but other wise, I hope I never have to. Hard to say though, heat of the moment, fear, adrenaline, and so on.

Now after we move to the boonies we just plan on eating anyone that trespasses, but that's different. We're a meat and potatoes bunch.

In Oklahoma-you still have to prove to a jury that this person/intruder was in the intent of doing you bodliy harm or intented to kill you. If you put a hole threw his head and he didnt have any weapons or wasnt walking out with your property then you "could be" brought up on charges. If you dont kill him and you cant prove the harm or theift then he could sue you for the injuries while being on your property. Your going to stand trail, whether your in the right or not.
