So, under 4(A)(ii) and 4(B) couldn't you say that the law could be challenged by the law itself? Because I'm sure there was a debated in their states House/Senate where the people voting for it were made aware of the distress and anxiety they would cause in a large portion of the population. It will certainly frighten the reasonable masses that their communications are able to be used against them so broadly.
