You are justified in using deadly force if you are threatened with death or serious harm. If the guy never points the gun at you or threatens you ,you may not be justified in using deadly force. If I could get the drop on him ,I would order him to drop the gun and get his hands in the air . At that point if he turned toward me with gun in hand I'd drop him. If he ran out the door ,let him go call police. The only way I'd shoot him in the back was if he started shooting at the clerk or someone else in the store. You shoot him in the back you may or may not get charged. You shoot him in the back and his family sues you, you may loose. I hope I never have to shoot anyone. I would if I had to but ,it not something you want to live with. I have a friend that did and it's not something that's easy to live with for most people. Read "On Killing" by Lt.Col. Dave Grossman.

Yes, Grossman's book is worth the read, for sure. Read it and think about what he says. There are many variables here, but the bottom line is if I feel you are a definite threat to me or my loved ones, then I hope the Lord will have mercy on you; because I will not.

I've already had this happen during my time as an LEO in Georgia. No firearms involved, perp got a year in county prision, and I went through hell with IA. I'm in a gas station filling up off duty, an go in to find another customer arguing with the store manager over the price of a quart of oil. Pretty good argument was going on with lots of colorful words, before I could say anything he grabs the manager looking for all the world like he was going to put his lights outs. Next thing I know is I'm standing over the perp with my small extendable baton, one of the ASP 8" to 16" models, after that I cuffed and called 911 to request assistance for aggravated assault, and battery. County PD came took my statement, and took our friendly perp to jail for processing, and for me to file my report. IA wanted to suspend me without pay, and take my badge cause I hit him from behind, and didn't advise him of my presence, or give a verbal warning first. Even with the video as evidence showing what I did, it got really ugly, as did the trial process for the perp.
