Being a lightweight drinker I have a question. To have a alcohol level of three times the legal limit would a person have to have a history of heavy drinking or can a person who drinks occasionally reach that level without passing out?

If a person is able to function (vice just stagger around and pass out) with that high a BAC, it may be indicative of long-term heavy drinking. Generally for alcoholics the last thing to fall apart is the on the job perfomance. Why? Its the big enabler that lets them continue to drink. The man lived and no one else was physically hurt. He may or may not be able to continue/return to being a cop but at least, if he is an alcoholic, he has a chance to realize how out of control his life has become and perhaps take steps to help himself. Some people have learned the same lesson under much worse circumstances.

Meh... it's too highly variable to predict, really. I've seen people passing out/puking down their lungs kinda drunk and have a BAC of less than 100, and people walking around talking with mildly slurred speech and slight ataxic gait at 500+. Certainly regular consumption affects it, but everyone reacts to it a little differently. And even the same person will be affected differently at the same BAD based on other factors of the day, somehow. I can't really explain it, but it just isn't predictable, unfortunately./QUOTE]

Yep. And for some people, the type has an effect, though that might be more psychological than physiological. (You know, kind of like in high school when you'd get drunk off of a 6 pack, but those 3 shots of Everclear in each of those 2 big gulps - 6 total - didn't seem to have any effect. Or the guy who can totally function on a half bottle of 90-proof Scotch, but has to hold on to the floor to keep from falling after 8 shots of Captain Morgan.)

If anyone really cares how many DUI tickets he's written, it's all public record and available online, as is anything else through courts of record. I almost rank that right up there with the string of Oklahoma politicians championing stronger and stricter DUI laws getting picked up later for DUI.

Also, it ain't locked as long as it remains civil.

The guy's eyes are pretty bloodshot in his mug shot. Including article on News9 for those interested in the boat damage. He's lucky no one was hurt. I do hope they charge him as they would charge anyone else who causes property damage while DUI and in possession of a weapon.

Ironically, I saw an OHP Tahoe pulling a Lake Patrol boat turning left onto OK39, heading west toward Lexington on the 3rd or 4th. I thought it odd that he was coming from that direction, as there aren't any ponds big enough to float that boat in the direction whence he came. Surely it couldn't have been the same boat and SUV...and no, I didn't call you Shirley. :P

Not trying to be snarky, but is this SOP for a civilian who's been busted for DUI and resultant property damage? Leaving aside the issue of being put on admin leave - which I assume means being paid to sit around - is the person usually released from jail with such charges pending? A friend of mine recently was arrested for an unpaid "loose dog" fine from a number of years past, and he had to sit in jail for two days before his bond was posted. So this DUI, which I think is much more serious than an unpaid fine, and release from jail within 24 hours made me wonder if that's normal.

LOL ... Lordy, I love you guys ... but you are worse than a bunch of women with your selective memories ... so, yeah ... let's go with that ... I "ALWAYS" stick up for the JBTs ... :rotflmao:

Yeah, pretty much.

Not to mention keeping an OHP officer in the county jail on a DUI charge might be less than conducive to maintaining order, OR his safety.

But yes, in my experience, being out within 24 hours of a DUI is not abnormal, and a lot of them never even get booked in, only cited and released. Even with property damage, even in injury accidents, although not usually in fatality accidents.

Again, in my experience.


And no, I've never had a DUI, nor been arrested.

I could think of a couple of duty stations worse than that .. :P And he wouldn't be in a car ... :lookaroun
