It’s only a textbook case of self defense if one ignores the fact that Kottka got out of his vehicle, in the middle of the road, to confront the deceased.

Nothing in his motion indicates the deceased entered, or attempted to enter, Kottka’s vehicle. That should be relevant…

And then there's the whole "Why didn't he just drive away? " question.

That’s interesting. Why does this guy think he has immunity from prosecution?

According to his attorney's filing, the other guy was the aggressor, instigating the incident and physically attacking Kottka, making this a self defense case. If that turns out to be true, then he would be immune from prosecution under Oklahoma statutes.

I don’t remember all the details. Did the dead guy actually put his hands on Kottka?

Edit to add I just went back and read the details, and depending on which eye witness you believe, the dead guy may or may not have touched Kottka.
