I don't have any particular problem with the criminal seizures, but the civil ones where they never even file a charge are crap. There was a bill to eliminate this theft by cop a few years ago.
LEO organizations lobbied against it, as well as individual county departments who claimed it would financially cripple the department.
There was an incident where such a person was driving a church van on a mission trip. Took a lot of fighting and press before the Sheriff would give the money back to the church. (Don't remember county but this sounds like it - 3-5 years ago.I remember this one but don't recall the resolution either. This is probably a sweet spot for seizures since there is no way you could justify an attorney to sue to get your $10k back. Except on principle.
Whole thing is crooked.
At what point does roadside thievery become "criminal"? When arrested? When charged? Convicted?I don't have any particular problem with the criminal seizures, but the civil ones where they never even file a charge are crap.
Civil should be wiped out. If not, they should have to pay 5X the seized amount plus attorney fees if someone sues and wins. But even then it's wrong.
I'd say if you are convicted of a crime. Otherwise, you are literally at risk of losing chunks of money if the LE thinks it 'looks fishy'.At what point does roadside thievery become "criminal"? When arrested? When charged? Convicted?
If a cop isn't arresting you for a crime, he needs to leave you alone and keep his hands off your stuff.
The moral of this story is,,,
Never carry large amounts of cash.
I've never heard of any LE confiscating a cashier's check.

Yes, how do they live with themselves at night...they probably think they are good, conservative, moral people too. The reason we lose and all this woke stuff advances, etc. is because of bad people on our side who masquerade as good people. The dems just do what they do and are akin to General Zod. But the real reason we are losing the country is because of Lex Luther. There was a case in Canadian County where a sheriff deputy stopped some Chinese men who had something in the 10k range in cash- it was confiscated, and the DA tries to connect them to drug activity with no drug evidence whatsoever. Of course, the DA continued forward with the intention of keeping the money, because it's just your taxpayer money paying for all this anyway. I didn't ever hear the outcome, but my take is that is there was no illegal activity that can be proven, how can they do that.
