Definition of "Engaged in the Business" changing?

Have you seen this in the Bipartisan Communities Safety Act:

19 SEC. 12002. DEFINING ‘‘ENGAGED IN THE BUSINESS’’.
20 Section 921 of title 18, United States Code, is
21 amended—
22 (1) in paragraph (21)(C), by striking ‘‘with the
23 principal objective of livelihood and profit’’ and in
24 serting ‘‘to predominantly earn a profit’’;


Discussion Draft S.L.C.
1 (2) by redesignating paragraphs (22) through
2 (29) as paragraphs (23) through (30), respectively;
3 and
4 (3) by inserting after paragraph (21) the following:

6 ‘‘(22) The term ‘to predominantly earn a profit’
7 means that the intent underlying the sale or disposition
8 of firearms is predominantly one of obtaining pecuniary
9 gain, as opposed to other intents, such as improving or
10 liquidating a personal firearms collection
: Provided, That
11 proof of profit shall not be required as to a person who
12 engages in the regular and repetitive purchase and disposi
13 tion of firearms for criminal purposes or terrorism.

As long as they don't change it to, "predominantly sells at a loss" I will be okay. :wink2:

If I’m reading it correctly, a person would have to claim that their collection is being liquidating, or you would have to use the money to buy another firearm. Is that correct?

I really doubt that most of us need to worry about that change. There are much larger fish who are buying and selling large numbers of firearms from FFLs to sell at a profit on the street. It makes me laugh when people get up in arms about the pseudo-registry created by the 4473. People acting in the gray area of the law don’t seem to care that their name might be linked to hundreds or thousands of firearms, they possessed for a few days or hours.
