Which is it? Can't be both!
This is not a mistake. It's a a method. It's to soften up the readers' opinion of the perpetrator...victimize him, or humanize him because he's forced by society to make these decisions.

So putting in past tense an attempt to do something - "he tried", gives the reader the initial sense that he didn't really do anything, so "why" did he get shot? = victim

Then the writer will follow up with the "suspect" rather than burglar or criminal and his action, but the seed has been planted in favor of the victim.

It's Mockingbird Media doing what it does best, which is manipulate the fools and unsuspecting.

Well you could be right. Personally I don't think they're smart enough to put that much thought into anything.
They are smarter than you think but mostly it's training and ideology. It's muscle memory to write crap and lies, and then to justify it by whatever method. A lot of times, these people will game plan what they will write about, especially when there is more than one author (you see this with all the big time commie lib rags).

Even with outlets like The Daily Caller, which is "right wing", their writers are taught methods in school. They can't help it.

If the Prosecutor thinks he/she can put the person in prison there will be charges filed.

If the Prosecutor doesn't think he/she can put the person in prison charges probably won't be filed.

The average win rate for Prosectors is 90+%, there is a reason for that.

Not sure why some people have such a hard time understanding something so simple.
