Thirteen states have enacted laws to allow immigrants to get driver's licenses without proof they are in the U.S. legally, and some restrict data sharing with federal authorities.

Denver officials didn't immediately respond to a request for comment from AP on the subpoenas. They were issued Monday. In three of the cases, officials have 14 days to respond with information, and in one case, three days.

The administrative subpoenas are usually sent by ICE to employers or landlords — but have never been sent to law enforcement agencies before, Lucero said.

The four men, three Mexican nationals and one Honduran, had all been arrested and jailed for violent offenses such as sexual assault and child abuse and had all been previously deported, according to ICE.

Immigration officials sent requests to a Denver jail to alert them when the suspects were released, but the city does not comply with such requests, much like New York, Philadelphia and San Francisco and other localities that refuse to help federal immigration authorities. Three of the four men were released, one remains in custody.

The police departments and sheriff's offices can have access restored if they certify the records they access won't be turned over to federal immigration agencies

The law, signed by Gov. Andrew Cuomo in June, allows state residents who entered the U.S. illegally to obtain a driver’s license without a Social Security number beginning Dec. 14. The law states that the information those residents hand over to the state for the driver’s license shall not be used by the federal government as a means to identify or deport them.

Local police agencies have access to the DMV database, though local agencies cannot tell based on the DMV records alone whether a license-holder came to the United States illegally, officials said.

The agreement with local police agencies is meant to ensure that they “do not disclose that information to ICE, Customs & Border Protection and Citizenship and Immigration Services as stipulated in law,” said Janine Kava, a spokeswoman for DCJS.

The federal government should shut off access to NCIC for New York. It is a two way street after all...

If it weren't for jeopardizing officer's lives I would agree.

That's part of the point. Those NY agencies would be screaming at Cuomo to get it reinstated.

It's unfortunate, but at some point we have to give LE AGENCIES a reason to back The People, not the tyrants. :(

Thought that the whole "Real ID" thing was supposed to prevent this sort of thing (illegals getting a state issued license) from happening in the first place. Should have known better.

I theory sure, but in practice? States can still issue any ID they want, it just isn’t valid for entering federal installations or flying commercial.

So the next step after decertification of NY for NICS access, would be to revoke their ID clearance for federal purposes. After that, defund N.Y. and NYC security and law enforcement in the federal budget. :D

New York has been beating up the federal government ever since Trump took office. It’s past time for Trump to hit back.
