I am not sure how pushing a car out of the water is an emergency. Therefore, I am not sure they would ever have to rescue you, according to your interpretation of the law.
Having said that, you would have to show me where the state laws says, emergency workers are required to render aid, if you refuse help, in Oklahoma.
Lastly, I never said I would drive my car into high water. Therefore, you did not have a reason to call my ass stupid. You should learn a few manners. Not many people post on this forum because of members like you.

Except that your own stupid actions can and will lead to people HAVING to rescue your ass... firedogs don't have a choice - if someone is doing something stupid and ends up in trouble (i.e.,carried away by rushing water), then rescue efforts must be made, not just turn your head and walk away and say, "Well, they chose it"... those in Emergency Services are required to try to save the lives of even morons. Which puts their lives at risk. So it's a public safety issue.

I guess if you want to let people do stupid stuff that will result in their death and then say they have no expectation that anyone will try to save them, then fine. For now, though, public safety is about more than choosing to risk your OWN life... you could be risking the lives of your rescuers, too.

I'm a grown adult, I can decide to put my life in jeopardy for whatever reason I deem appropriate and yes I can also accept the possible consequences. What I DON'T need is big brother thinking I'm not qualified. Saw too damn much of that in the tornadoes of late. SCOTUS has ruled that there's no duty to protect or some such phraseology. Someone needs to let our leaders know.

ETA: I'm not saying that's what happened here because we don't know what really happened. But it sure "feels" that way. I'll withhold an opinion on this one until one can be made.

I'm thinking that if the river came up over 20' in an hour and you were caught in it,(like some have) you wouldn't be swept down stream screaming "don't rescue me".

Its certainly your right to commit suicide by being a dumb a$$, but at the time you holler help on your way down stream, emergency services kick in.

If you don't think emergency workers have a responsibility to respond to an emergency, then I'm afraid I can't help you understand that concept. And I never called YOU stupid... I said if you want to let stupid people do stupid things, then make sure no one else is affected by them - and in today's world and political climate, they are.

But if you WANT to be offended by a simple discussion, be my guest. I'm not here to pat you on the head and hold you or anyone else by the hand... I deal with enough stupidity and people doing stupid things and putting themselves at risk on a daily basis - I think I could be considered an authority on the subject of legal liability in trying to pull the morons out of the fire. ;)

Emergency Services and healthcare workers have a DUTY TO ACT. It's quite simple.

I'm pretty certain that officer had no legal obligation to help those guys at all, duty or not. There are holes in this story and it might get interesting to find out all the details (if we ever will)

I agree, I'm pretty certain that OHP doesn't carry swift water rescue gear in their vehicle, and it requires more than one person to execute that type of rescue if needed. They can call for the necessary resources though. Two guys pushing a vehicle out of the water, who knows........we don't know what the water was like, depth, speed and width.
From the fire/ems side..........I'm going home after the call, so is the rest of my crew. Accidents happen, training and training and training help lesson the odds of an accident happening..........training also helps you recognize when you need other resources that you're not capable of providing. Being the hero is great if it works out that way, me wading out into swift water without the gear, crew and training..... no way. I'll make the calls necessary and hope they get there in time. Swift water is a different cat than crawling on hands and knees through a smoke filled structure doing a search. Duty to act involves more tha diving in blind.......if somehow I make it to the victim, what do I do with them? Then two of us need rescued. Someone above mentioned the deputy going in to rescue, and almost lost his life, this is what I'm referring to. Getting caught up in the moment can kill you.

This worries me greatly. This is on our own doorstep, in our own backyard. This isn't Baltimore or New Orleans...it's right here in Oklahoma.

Just another reason never to talk to the cops...period.

I cannot imagine any scenario that would require an officer to shoot someone he was sent to assist in getting out of flood water.

That said, I cannot imagine any scenario where someone an officer showed up to assist would attack that same officer.

Not enough info out yet for me to pass judgment on this one but something tells me that there is a REAL interesting story behind all of this.


Something tells me unless you(not you BB but anyone in general) know the officer personally, there will be no way to know the whole unblemished story. There will be an investigation and both sides will have their story, but the REAL truth will likely never see the light of day.

Sounds to me like a bad situation made a turn for the worst(for everybody involved). Most of the time these things can be avoided, but they do and will continue to happen.
