Sure it was. If you have enough pc to get a search warrant, you have enough pc to detain the suspect.
But they weren’t interested in detaining him, yet…they had a search warrant for his home. Why would they serve him a search warrant for his home while he was away from home? Makes zero sense.

People who haven’t even read the affidavit are grasping at straws. Not apologizing for ATF in anyway but this dude wasn't the poster child we want or need…

Was he going to be detained while the search happened? Or just able to run around freely?

If detained, it would make perfect sense to do that outside his house, in the open, and nowhere to take cover.

He “wasn’t the poster child we want or need” so it’s OK they killed him?

Even if you find pre-dawn raids for process crimes acceptable, your idea that they weren’t interested in detaining him “yet” is just silly. They ran a LONG investigation on him for reselling Glocks and decided it was time to seize evidence from his home with a warrant. But they didn’t want to detain him yet? So instead, they set up a pre-dawn raid that maximized the chances of him defending his home from invaders, which resulted in the firefight where they killed him. Oh, and you don’t think they intended to “detain” him and perp-walk him to the car in his underwear like they do so many others? LOL

How in the butternut squash does that make any sense to you?

If all you want to do is seize evidence that obviously can’t be flushed in the time between the knock and entry, you do it in the daylight when the residence is either unoccupied or the primary suspect is not there. Even the ATF is known to do this, just ask Johnny Lawmaster in Tulsa, OK!

You do what they did so you can justify your tactical gear and training, and you do it to send a message. It’s literally indefensible to anyone who finds feds killing citizens in their own homes to be bad news. :rolleyes2

If you hate the ATF you have to anoint Malinowski as a saint

If you love federal law enforcement then Malinowski has to be painted as a blood thirsty killer

But there another option: Malinowski was a dipwad who openly, freely, and knowingly engaged in unlawful firearms sales for profit and set up a perfect excuse for a power hungry and sloppy federal agency to target him. Then bad things happened.

What’s some of the favorite sayings that can apply here? FAFO? Play stupid games, win stupid prizes?

Cool story. You should go back to ignoring me.

If they had served the warrant when he wasn’t home. People like you would be outraged that they smashed his doors in, tossed his house, and torched his safe(s) open.

You don’t even have the details of “the raid” yet. We don’t know it was a no knock. You’re jumping to a bunch of conclusions.

For all we know, they knocked and he opened fire.

Waiting for some info might be a good idea.

Are you being serious with this? You feel that a pre-dawn raid was the best way to search his house? Why not have a couple follow him to the office and watch him while they are searching his house? Sounds like they were following him for months anyway.

No one is claiming he's some some of saint, but I've seen nothing justifying what happened. Seems more like a strategy to maximize the chances of the outcome they got.
