Not one iota. Someone just went and found it and processed it.
The writ was served on the OSBI Director. I'm sure that it went directly to legal where s..t probably hit the fan. There is still the issue of attorney's fees and costs. If I were them, I would be concerned about a class action suit being filed.
It actually has been fun and educational. I havn't filed a civil action in years. I play in the criminal courts.Nice job! Too bad it had to be such a hassle.
I am glad he got his license, but the fact is, there were (at least potential) monetary damages incurred by OSBI's failure to abide by the law, in the form of attorney's fees. I think more of this type of thing should be done and brought to the attention of the powers that be... the cost is not going to be a big deal to them in the longrun, it was pointed out above how much jack they are bringing in by the processing of these applications. I would like to see the legislature force an audit of where those extra funds are going - no way they are spending that many millions per year on a few backbround checks (mostly internal) and a few clerks pushing some papers.. If they are going into the general OSBI budget, then I think that is BS and the law needs to be ammended to require ALL funds acquired through SDA applications and permits to be used for purposes specific to that arena. So they MUST use the funds to either hire more staff dedicated to bringing them up to processing speed, and/or any extra funds left over should result in a mandatory decrease in initial application and renewal fees to make them more commensurate with the amount of effort and expenditure required to allow Oklahomans to exercise their Constitutionally-protected right.

<edit> That is, instead of making a net profit off of those of us who choose to exercise our rights and force us to subsidize a law enforcment agency to a degree higher than that of the citizen who does NOT participate to the same degree in his own defense or exercise his rights.
