The issue about the private server. Was she negligent of keeping America's secrets safe and was she using a private server to keep government records away from IG or other audits is part of the problem for Ms. Clinton.

When Michael Hayden (ex NSA/ex CIA) was asked about Clinton's private server he stated that if he knew of a ranking diplomat of even a "friendly country" doing that, he "would move heaven and earth" to get to that information. Good bet our "friends" and our enemies feel the same way and were aware that Clinton's email was not a State email when they saw "Clintonemail.com".
This will come down to IF Obama feels saving or throwing Clinton under the bus will benefit his legacy and what the fallout could be to not prosecute if the case is strong that they should.
