Hey, wha ,wait, I was in a pawn shop today! Nah, I don’t partake but it did get me thinking. What if you know or learn that a person has a card in a private sale? I know the simple answer for some is ‘big deal’ but what is the legal answer? Just curious

IMHO you cant have your cake and eat it too. I'd rather be able to protect myself than smoke a plant that grows in the ground. So, therefore I do not partake in that activity. I know a few coworkers who have their card though. I am surprised that my employer allows people to work around machinery and have a card. But, of course you cant come to work messed up.

i guess what I’m angling to is, do we need to start asking if a buyer has a card in private sales? I mean, everyone I know that have a card are good solid people. Some I’ve known for 30+ years.

Unless the prosecutor has a picture of you and the person you sold the gun together with that person holding their MM card for all to see, they have no way to prove you knew they had a MM card or even partook in the devil's lettuce. Just don't do a FTF at a dispensary and you should be good.

The legal answer is clear. If they have a MMJ Card and you know about it, it is illegal for them to own firearms or ammunition. Federal laws aren’t kidding around. Transfer a weapon to a pot head in a private sale, and you know said individual is a dope smoker, welp, that’s a violation on your part as well as the doper’s. We don’t have to agree or like it, and many think alcohol is a worse thing than pot, but booze is legal and pot isn’t; so say the Feds. Best plan is to not smoke dope and talk about it, not smoke dope and have weapons and ammo ( and talk about it) and maybe to decide which you’d rather have; guns and ammo or marijuana.

Now, some of the members here use drugs much more powerful than marijuana. Opioid pain relievers, for example. But opioids are legal, according to the feds, if prescribed, and may make you see snakes with funny hats and have bad dreams about fat bald headed clowns with lots of teeth but you can still own weaponry. But puff a joint (and chill out as I understand) which (so I hear), mellows you out, (I’ve been told) and you’re a hardened criminal bound for the federal pen.
