Most people have the wrong idea of what trespassing entails. As a cable tech I enter back yards all the time without the homeowner's direct consent. The reason this is not trespassing is I have a legitimate reason to enter that yard and my company has easement access rights granted to us by the cities and counties that our service is active in. When someone purchases a house there is a section that spells out what easements are on the property and states that those services that are in the easement have the right to get to the easement even if they have to cross the property to do so.

Yep, one of you boys got confronted with a firearm after I found one kicking at my dogs who were going crazy in the back yard.

Trespassing, burglary or sightseeing is irrelevant unless the McMichaels witnessed it or had “immediate knowledge” of it as defined by Georgia case law. Barring that, their pursuit, attempted armed detention, and introduction of deadly force was unlawful.

Yep, one of you boys got confronted with a firearm after I found one kicking at my dogs who were going crazy in the back yard.

So far that hasn't happened to me, though I did have a lady let her dogs out once when I was in a backyard. This was after I knocked and rang the doorbell to let her know I was going back there. She was pretty apologetic about it. Dogs didn't attack though one got somewhat aggressive until the lady called him back in.

I've had a few people get angry for me being back there, but never had a gun pulled on me yet.

Not in bad shape from what I can see. Got some dopers and an alcoholic or two living under here.

Ever have to shoot a dog while at work?

Got a couple in my neighborhood liable to get shot. They get out a lot and have caused chaos. In fact, I witnessed them attack my neighbor's dog a couple of weeks ago and try to force their way into his house pursing her, and then this past Saturday they attacked an old lady's cat while she was in her backyard. She got bit (she's in her 80s) trying to stop it, then retreated into her house and called the cops.

Cat dead.

Dogs? Returned around the block to their owners by the police.


Anyone want to guess the breed of these two dogs?
