That should suffice in a court of law. Human error during a chaotic moment. Plead a complete and total accident.
You can plead that, but I'd rather avoid being drug through the mud and wrecked financially during the criminal legal fight in hopes that it works...only then to be exposed to civil litigation.
Avoidance and calm action when that fails is much better IMHO.
