Prob not, since official time of death was hours later.

The time the individual took their last breath is not necessarily the time at which they died. This may sound bizarre but taking into consideration the human body can function for a period of time without oxygen - the human brain reportedly surviving several minutes without it - then it is reasonable to assume that the time of death may not always be accurate.

If I were the family, I'd get a second opinion from an independant Pathologist.

The ME didn't have a "Justifiable" homicide box to check. Bet his family shows their ID from now on.

This right here. If you are asked to show ID, stop moving, whatever the **nice police officer** asks of you - you better comply. There's been a lot of complying in my part of the state lately, for sure.
