It depends on what the fines are for. If it is restitution or court costs, they have to be paid. Some fines are jail or pay, some are jail and pay. In Oklahoma, the DWI fines are jail AND fine, so it sounds like he will have to pay regardless. The jail will be punitive for not paying and not showing up to court.

He really needs to get help to quit the drinking. If he's had a conviction in Oklahoma for DUI and goes to court again on a DUI, they can charge him with felony DUI instead of misdemeanor. If that occurs and he is convicted again, felony charges can bring much worse sentences.

WOW. I could see probation but having to pay after serving is no bueno. setting people up for failure.

Depends...more often it's giving people an excuse for failure.

My wife worked probation/parole/drug court for years. Every month she had folks standing in front of her desk with sob stories about not being able to pay, while sporting new ink and piercings LOL.
